The state of California’s Division of Occupational Safety and Health, better known as Cal/OSHA, is perhaps the most aggressive and enforcement-heavy approved state OSH Program in the nation.  California employers face a host of requirements that other employers around the country do not.  Likewise, the Cal/OSHA inspection and appeal process creates several unique landmines for California employers.  Of particular significance in the coming year, California employers should be on the lookout for new E-Recordkeeping injury data submission requirements, a new focus on finding Repeat violations, and the real roll-out of new rules promulgated last year, such a ergonomics in hospitality, workplace violence in healthcare, and others.

Eric J. Conn is a founding partner and Chair of the national OSHA • Workplace Safety Practice Group at the law firm Conn Maciel Carey LLP, where he focuses his practice on all aspects of occupational safety & health law.  Mr. Conn represents employers in inspections, investigations and enforcement actions involving OSHA, the Chemical Safety Board, MSHA, EPA and state and local safety related agencies.  He also handles all aspects of OSHA litigation, from criminal prosecutions to appeals of citations.

Megan Stevens Shaked is an Associate in the San Francisco office of Conn Maciel Carey LLP. 

Ms. Shaked represents employers on a wide range of employment matters, including claims of discrimination and harassment, wrongful termination, wage and hour violations and whistle blowing.  She also represents clients in inspections, investigations and enforcement actions involving Cal/OSHA.  She also represents clients against claims brought by patrons alleging lack of accessibility under Title III of the ADA and the California Unruh and Disabled Persons Acts.
