For more than 20 years, the Congressional Review Act (CRA) – a powerful “Contract with America”-era law that enables bare majorities in Congress to push through repeals of regulatory safeguards – has lain largely dormant. Ever since conservatives secured control of the White House and Congress following the 2016 election, though, this law has been put to frequent and controversial use, having been used 15 times already to repeal regulations.  And still more repeals appear to be on the way as conservative lawmakers have just created a huge loophole in the CRA that would allow them to use it against a new target: agency “guidance” documents, including some that are years’ or even decades’ old.
What is the CRA? What explains the extreme uptick in its use over the past year? And what effect is all this having on the public interest? On Monday, May 7, at 1:00 p.m. the Center for Progressive Reform (CPR) is hosting a webinar that will answer these questions and more about the CRA. Leading the webinar will be CPR Member Scholars Tom McGarity and Rena Steinzor and CPR Senior Policy Analyst James Goodwin, three co-authors of the recent report, The Congressional Review Act: The Case for Repeal. The webinar will explain why the CRA is such a profoundly dangerous law and that lawmakers should repeal it immediately and reinstate the regulatory safeguards it has been used to rescind. In particular, the webinar will highlight the following:
  • How the CRA has enabled conservative lawmakers to deploy its provisions in reckless fashion, wiping out critical regulatory safeguards and depriving the public of significant public health, safety, environmental, or financial security protections;
  • The long-lasting damage the CRA is doing to the legitimacy and integrity of our democratic policymaking institutions; and
  • The lack of any credible offsetting policy justifications for the continued use of the CRA.
