Fate of Midnight Obama-Era OSHA Rules

In the final days (and even hours) of the Obama Administration, OSHA promulgated several significant regulatory changes.  For example, after several decades, it updated the Walking Working Surfaces Standard (the regulation covering slips, trips and falls).  It also published a controversial Electronic Injury Data Submission Rule, two new occupational health exposure standards for silica and beryllium, and brought the U.S. Hazard Communication Standard (the chemical right-to-know regulation) more in line with the United Nation’s Globally Harmonized System of Classification and Labeling of Chemicals.  To name a few.  

But, as a new administration took the reigns at the Department of Labor, many wondered what would be the fate of these "midnight rules"?  While many agency regulations have been subject to additional rulemaking (or even rule-rescinding), as expected given Pres. Trump’s promise for deregulation, others have remained untouched.  This webinar will review the status of these OSHA Rules and where they may be headed.

Kathryn M. McMahon is a partner in the national OSHA • Workplace Safety Practice Group of Conn Maciel Carey LLP. She focuses her practice in the areas of occupational safety and health (OSHA) law and environmental law. Ms. McMahon helps clients manage incident and fatality inspections, and litigation related to alleged violations by federal OSHA and state OSHA programs.  She also represents industry stakeholders in all aspects of OSHA rulemaking, including proposed rules regarding silica, injury and illness recordkeeping, hexavalent chromium, and beryllium, among others.

Micah Smith

Micah Smith is a Partner in the national OSHA • Workplace Safety Practice Group of Conn Maciel Carey LLP. He focuses his practice in the areas of occupational safety and health (OSHA) law.  Mr. Smith represents clients in the full range of OSHA-related matters across a wide range of industries, and works with his clients to identify safety and health strategies that both increase employee safety and improve business performance.

Beeta B. Lashkari

Beeta B. Lashkari is an Associate in the Washington, DC office of Conn Maciel Carey LLP working in both the OSHA and Labor and Employment practice groups.

Ms. Lashkari advises and represents clients in a wide-range of inspections, investigations, and enforcement actions, including those from OSHA, EPA, CSB, and state and local regulators. She handles all aspects of litigation against OSHA, from citation contest to hearings before administrative law judges. Ms. Lashkari provides legal advice to clients regarding compliance with all OSHA rules and standards.

Prior to entering private practice, Ms. Lashkari was an Attorney-Investigator for the CSB, where she developed comprehensive written analyses of OSHA and EPA regulations for numerous investigation reports, provided legal advice regarding the agency’s statutory authority and jurisdiction, and negotiated safety recommendations with corporations, regulators, and trade associations.

Deacon is an Associate in the Washington, DC office of Conn Maciel Carey LLP, working in both the Labor and Employment and OSHA • Workplace Safety Practice Group.  Dan's practice focuses on all aspects of occupational safety & health law and labor and employment law.  He represents employers in inspections, investigations and enforcement actions involving OSHA and other state and local safety related agencies.
